\u00darad na ochranu oznamovate\u013eov (\u010falej len \u201e\u00farad\u201c) sa obozn\u00e1mil s\u202fposlaneck\u00fdm n\u00e1vrhom novely z\u00e1kona \u010d. 54\/2019 Z. z. a\u202fpova\u017euje za potrebn\u00e9 gestorsk\u00fd v\u00fdbor upozorni\u0165 na z\u00e1va\u017en\u00e9 rizik\u00e1 predlo\u017een\u00e9ho n\u00e1vrhu nielen z\u202fh\u013eadiska postavenia oznamovate\u013eov v\u202fpraxi ale aj z\u202fh\u013eadiska integrity vy\u0161etrovan\u00ed podozren\u00ed z\u202ftrestnej \u010dinnosti. N\u00e1vrh tie\u017e poru\u0161uje \u00fastavn\u00fd princ\u00edp retroaktivity a\u202fz\u00e1v\u00e4zky Slovenskej republiky vypl\u00fdvaj\u00face zo Smernice Eur\u00f3pskeho parlamentu a\u202fRady (E\u00da) 2019\/1937 z 23. okt\u00f3bra 2019 o ochrane os\u00f4b, ktor\u00e9 nahlasuj\u00fa poru\u0161enia pr\u00e1va \u00danie (\u010falej len \u201esmernica E\u00da\u201c).\u00a0 \u00darad konkr\u00e9tne poukazuje na nasledovn\u00e9:<\/span>\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t N\u00e1vrh v\u202fbodoch 1-3 stanovuje, \u017ee ochranu by mal oznamovate\u013e z\u00edska\u0165 iba v pr\u00edpade, ak sa ozn\u00e1menie t\u00fdka priamo \u201eosoby zamestn\u00e1vate\u013ea\u201c. Tak\u00e9to obmedzenie je problematick\u00e9, preto\u017ee v praxi \u010dasto <\/span>nie je mo\u017en\u00e9 identifikova\u0165 konkr\u00e9tnych podozriv\u00fdch v \u010dase podania ozn\u00e1menia<\/span><\/b>. Smernica E\u00da po\u017eaduje ochranu ozn\u00e1men\u00ed, ktor\u00e9 obsahuj\u00fa inform\u00e1cie o\u202fpodozreniach, ktor\u00e9 ohrozuj\u00fa verejn\u00fd z\u00e1ujem a\u202fktor\u00e9 boli<\/span> zisten\u00e9 v r\u00e1mci v\u00fdkonu pr\u00e1ce<\/span><\/b>, a to nielen vo\u010di zamestn\u00e1vate\u013eovi, ale aj vo\u010di spolupracovn\u00edkom, dod\u00e1vate\u013eom \u010di in\u00fdm in\u0161tit\u00faci\u00e1m.<\/span>\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t Zmeny navrhovan\u00e9 v\u202fbode 4, teda v\u202fnovozaradenom \u00a7 7a a\u202f\u00a7 7b\u00a0 umo\u017enia zamestn\u00e1vate\u013eovi odvola\u0165 sa vo\u010di udelenej ochrane a\u202fopakovane, ka\u017ed\u00fdch 6 mesiacov \u017eiada\u0165 o od\u0148atie u\u017e udelenej ochrany. Tak\u00e9to ustanovenie vytvor\u00ed pre oznamovate\u013ea obrovsk\u00fa pr\u00e1vnu neistotu.\u00a0 Z\u202fn\u00e1stroja prevent\u00edvnej ochrany a podpory oznamovate\u013eov sa tento in\u0161tit\u00fat zmen\u00ed na <\/span>n\u00e1stroj ohrozenia a potencion\u00e1lneho \u0161ikanovania oznamovate\u013eov.\u00a0\u00a0<\/span><\/b>\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t Pr\u00e1vo na podanie odvolania zamestn\u00e1vate\u013ea vych\u00e1dza z\u202fnepochopenia in\u0161tit\u00fatu ochrany, ktor\u00fd je vz\u0165ahom medzi \u0161t\u00e1tom a\u202foznamovate\u013eom, kedy \u0161t\u00e1t pos\u00fadi kvalifikovanos\u0165 podnetu a\u202fuzn\u00e1 tak potrebu prevent\u00edvnej ochrany. Zamestn\u00e1vate\u013e je pod\u013ea aktu\u00e1lnej pr\u00e1vnej \u00fapravy informovan\u00fd len o\u202fudelen\u00ed ochrany.\u00a0 Informovan\u00edm zamestn\u00e1vate\u013ea o\u202fd\u00f4vodoch ochrany tak, aby sa mohol odvola\u0165, sa z\u00e1rove\u0148 <\/span>ohroz\u00ed vy\u0161etrovanie podozren\u00ed z trestnej \u010dinnosti \u010di spr\u00e1vnych deliktov. <\/span><\/b>Rovnako tak ned\u00e1va zmysel, aby boli preverovan\u00e9 d\u00f4vody trvania ochrany, ke\u010f\u017ee doba jej trvania je stanoven\u00e1 z\u00e1konom.\u00a0<\/span>\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t N\u00e1vrh novely umo\u017e\u0148uje presk\u00famanie a\u202fz\u00e1rove\u0148 zru\u0161enie u\u017e v\u202fminulosti priznanej ochrany rozhodnut\u00edm pr\u00edslu\u0161n\u00e9ho org\u00e1nu, \u010do predstavuje <\/span>nepr\u00edpustn\u00fa retroaktivitu<\/span><\/b>. Ide o z\u00e1sah do pr\u00e1v, ktor\u00e9 u\u017e boli oznamovate\u013eovi priznan\u00e9 pr\u00e1voplatn\u00fdm rozhodnut\u00edm. Tento postup bol v minulosti kritizovan\u00fd z d\u00f4vodu mo\u017en\u00e9ho rozporu s \u00fastavou.<\/span>\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t Eur\u00f3pska smernica vy\u017eaduje \u00fa\u010dinn\u00fa ochranu pred odvetami za podan\u00e9 ozn\u00e1menie.
